Privacy Policy

This Privacy Policy describes the types of information that may be collected and the manner in which any such information is collected and used by RMS Software, Inc. ("RMS") in connection with the services and applications offered by RMS, which are offered to individuals either directly by RMS or indirectly through organizations that have contracted with RMS (“Clients”) to provide RMS services to their constituents (i.e., a Client may be an organization that contracts with RMS to provide RMS services and applications to the Client’s employees, students, citizens, etc.).

The disclosure of personal information ("PI") is a sensitive and serious issue, and RMS considers it imperative to protect the privacy of registrants ("Members"). Therefore, RMS will collect, use and disclose PI in accordance with the terms of this Privacy Policy for the purposes of enabling you to get the maximum benefit from RMS' services, the RMS website and any website maintained by RMS for a Client who make RMS’ services available to you (the "Sites"). By opting in and registering for the use of RMS’ services, you agree to the collection, use, retention and disclosure of your PI as described in this Privacy Policy.

1. Registration

In order to register as a Member, you must provide certain PI to the Site, or to a Client who has contracted with RMS to provide the services provided via the Site. The nature and amount of PI you are required to provide will depend upon the RMS service for which you are registering. The PI may include information such as your name, street address, phone number, fax number, email address, instant messenger identity, Client, school, institution or company affiliation, username, password, and other information that you or the Client makes available to RMS. All such PI will be stored on computers under RMS’ control and will be subject to this Privacy Policy.

RMS owns or otherwise controls the servers that process and store PI and any messages, images, profiles, reviews, listings, or any other content ("Content") that you publish, display, or otherwise transmit directly or indirectly ("Post") on the Sites, in whatever form. RMS will endeavor to use reasonable efforts and standard industry practices to keep PI confidential and to protect it from unauthorized access, use and disclosure. The security measures employed by RMS are described in Section 8 hereof. By using the Sites and RMS’ services, you agree that RMS may share your PI with third parties as set forth in Section 3 hereof.  If a Client has subscribed to RMS’ services and you are a constituent of that Client, then, by opting in to use the RMS service, you agree that, at that Client's request, RMS may share your PI with that Client for the purposes of administering and using the Site’s services, as well as reviewing reports detailing usage of the Site.

2. Your Profile

2.1 You will be asked to create a Member account ("Account"). If you choose to do so, your Account may be configured to enable you to be identified by others as you use the Sites.

2.2 Your Account will generally include information regarding your wireless phone number and your wireless carrier or any other contact information you provide.

2.3 Your email address is used to contact you in connection with your activities on the Sites (including, but not limited to, confirmation emails or important news affecting your relationship with your municipality, school or company, as applicable). It may also be used to gather feedback via surveys to enable RMS to improve the Sites according to your needs and to forward messages to you from other Members.

2.4 RMS may use aggregated Member data for external purposes (such as reporting total monthly messaging volume utilizing RMS services) and internal purposes (such as maintenance of RMS software used in connection with the provision of its services); provided that such information shared with third parties will be aggregated in a manner that prevents Member PI from being identified to, or associated with, a particular Client or Member.

3. Third Parties

RMS will not disclose your PI to third parties, except as follows or as otherwise set forth in this Privacy Policy:

a) if disclosing your PI is reasonably necessary to execute a specific request by you or a Client (e.g., your wireless phone number may be submitted to other service providers in order to transmit messages that you send or receive) or in connection with third-party services provided to or on behalf of RMS (e.g., certain PI may be disclosed to or accessible by a company servicing RMS’ computer systems or administering the Sites). In these cases RMS attempts to ensure, including through the use of confidentiality agreements, obligations or policies, that the third parties will not collect, use, disclose or store any PI except to provide the specific services requested by you or RMS;

b) if RMS believes in good faith that such disclosure is reasonably necessary to: (a) comply with (i) any law or regulation, (ii) a judicial or criminal proceeding or investigation, (iii) a court order or legal process served on RMS or a Client, (iv) a Client's internal proceedings or investigations for alleged violations by you of the Client's policies or codes of conduct, or (v) an agreement between RMS and a third party service provider of RMS or Client that requires the disclosure of your PI to provide the RMS services to you; (b) to enforce the Terms of Use that govern your use of RMS’ services and the Sites (the "Terms of Use"); (c) to respond to claims that the Content you post violates the rights of third parties; or (d) to protect the rights, property or personal safety of a Client, RMS, the wireless carrier providing access to the Services, other Members or the public;

c) if permitted by the Terms of Use;

d) if RMS sells assets or is acquired by or merges with another entity, in which event your PI may be disclosed to the acquiring or successor company and its professional advisors who are under an obligation of confidentiality; or

e) if you otherwise give RMS explicit permission to disclose your PI.

We do not now and do not intend to sell, rent or market PI to third parties.

4. Links

You may occasionally see on the Sites links to other websites. RMS is not responsible for the privacy practices of other websites you may visit through a link you found on the Sites. If you provide information directly to a party other than RMS, different privacy policies may cover that party's use of your information. Please review any third party's privacy policy before disclosing your PI to that party.

5. Cookies and Log Files

The Sites may use cookies and web log files, including IP addresses, to track Member usage on an aggregate and anonymous basis or to help diagnose problems with RMS’ server or to administer its services.

6. Children

The Sites will not knowingly provide access to the Sites to persons under the age of eighteen (18) without parental consent. If RMS learns that a Member is under the age of eighteen (18) and does not have parental consent, appropriate steps may be taken to remove the Member's PI from the database and restrict the individual from future access to the Sites. Any registration by, use of or access to the Sites by anyone under 13 is unauthorized, unlicensed and in violation of RMS’ Terms of Use.

7. Security

RMS has implemented security measures designed to protect Member PI from loss, misuse and alteration. RMS uses practices that it believes are industry-standard, such as encrypted storage, firewalls and password protection systems, to safeguard the confidentiality of your PI. Passwords are encrypted and hidden from System Administrators, and other types of PI may be encrypted using industry best practices. Only authorized RMS personnel are permitted to access PI, and these personnel are required to treat this PI as confidential. Despite these precautions, it is not possible to guarantee the security of PI, including PI stored on a computer or transmitted over the internet, a computer network, or by wireless carrier. Accordingly, RMS cannot guarantee that unauthorized persons will not obtain access to PI.

8. You Have Control Over Your Personal Information

You can change your PI stored on the Sites at any time, whether it be the information supplied at registration, as part of your Profile or Account, or anything else. You may change information in, as applicable to your RMS service, the "My Profile", and/or "My Account" areas. In some cases, the Client may provide your PI to RMS on your behalf, and you may contact the Client to request changes to PI supplied to RMS by the Client.

9. Changes to this Privacy Policy

RMS may update this Privacy Policy at any time. The latest version of the Privacy Policy will always be available here and the most recent revision date will be indicated at the top of this page.
